Land Development and Stormwater Consents in Auckland – the regional Network Discharge Consent

Auckland Council Healthy Waters is expecting a decision from the Environment Court granting a regionwide Network Discharge Consent (NDC) for stormwater discharges. It will be a single consent that requires best practice standards to manage stormwater discharge across all Tāmaki Makaurau. It replaces 116 different consents and will be a key tool in the holistic management of stormwater and the region’s natural water assets. It will deliver savings, efficiency, consistency and improved environmental performance, while supporting growth.

This consent has implications for all those working in the land development and stormwater sectors, especially where stormwater enters or interacts with the public network – both for small scale and larger scale developments.

Paula Vincent and Gemma Chuah from Auckland Council Healthy Waters will give an overview of the consent and what it means for developers and implementing developments. This includes:

• What the consent is and the key outcomes and objectives including benefits to Auckland – and national policy
• How the consent fits into the Auckland Unitary Plan framework for stormwater discharges
• Key features of the consent including Stormwater Management Plans and performance requirements
• Key features to be included in a Stormwater Management Plan and the SMP template
• How an SMP gets adopted and any modifications (a big focus of appeals)
• The Technical Reference Group and its role to provide independent advice to the Regulatory Manager in case of a dispute with Healthy Waters.
